Funtime Gifts Ltd — Terms and Conditions

Payments

Standard terms are 30 days from the date of invoice subject to credit approval. Merchandise is invoiced at the time of dispatch. All goods remain the property of Funtime Gifts Ltd. until fully paid for in full.

Interest may be charged on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002. No sums claimable by you may be offset against any sums owing to us.

New Accounts

Orders must be over £150 (for Mainland UK only) and all new accounts must complete the new customer registration form. It sometimes takes a while to open a credit account, but not to worry — if you are in a hurry, payment by credit card is acceptable.

Pricing

All prices are exclusive of VAT and for wholesale quantities only. Unfortunately, prices are subject to change without prior notice. Whilst we always try very hard to avoid price increases, it is sometimes inevitable. Our sales team will endeavour to let you know of any alterations when your order is received.

Delivery

We will endeavour to meet the delivery date given at the time of order and, where this changes, will try to let you know at the earliest opportunity. We will always try to send complete orders; where this is not possible you may receive your order over a number of deliveries. Non-delivery must be reported to us within 3 working days of the invoice date.

Returns and Errors & Omissions

Best endeavours are always made to ensure the product you order is as it appears and as described in our catalogue. Should you feel misled in any way, Funtime Gifts will be happy to take back any item within 7 days of delivery for a full refund. Should an item arrive damaged or in any way not match your invoice, please inform us within 7 days for it to be rectified or replaced, whichever is appropriate.

Risk and Title

Risk in the goods passes to you upon delivery. Ownership of the goods passes to you only once all sums owed to us have been paid in full, including any sums outstanding from previous orders.

Export Orders

Standard terms are ex works. Please discuss with our sales team for more information on shipping and import requirements. Orders must be at least £1,000 or currency equivalent. If you are an export customer, it is your responsibility to ensure that our items comply with the import requirements and laws of the destination country relating to the sale and supply of goods. We do not accept liability, including costs, for any goods held at a port of entry or that fail to meet the sale and supply obligations of the destination country.

Product Recall

Should a product recall be necessary, we will notify you promptly. You must immediately cease selling any recalled goods and provide reasonable assistance to recall them as a matter of urgency. We will reimburse the reasonable costs of doing so, either directly or through our insurance, unless the recall arises from tampering or changes made to the goods by or on behalf of you.

Catalogue Life

Our current printed catalogue covers the period indicated on the cover, spine, or front pages. We make every effort to hold pricing and carriage charges for the life of the catalogue but reserve the right to make changes.

Liability

We accept no liability for loss of profit or any indirect or consequential loss arising from the supply of goods under these terms. Our total liability to you, however arising (save as set out below), shall not exceed the price of the goods in question. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, breaches implied by section 12 of the Sale of Goods Act 1979, defective products under the Consumer Protection Act 1987 (where applicable), or any other matter which it would be unlawful for us to exclude or restrict.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these terms to the extent this is caused by an event beyond our reasonable control which, even if foreseeable, was unavoidable.

Governing Law and Jurisdiction

These terms, and any dispute or claim arising from them (including non-contractual disputes or claims), are governed by English law, and the English courts shall have exclusive jurisdiction.
